Third Class Action Lawsuit Filed Against DFS Operators
A third class action lawsuit has been filed in the US District Court for Cleveland by a pair of Ohio residents who say that DraftKings and FanDuel are running an illegal online gambling operation and should refund all deposits. DraftKings had not responded when asked for a comment but FanDuel said the company would not comment while litigation is pending. According to the Ohio Attorney General's office there are no state laws against prohibiting daily fantasy sports. Continuing on the topic of DFS, USA Today reported that the NBA continues to support the industry and maintains an equity stake in FanDuel and a marketing relationship with DraftKings. NBA Commissioner Adam Silver said, "I continue to view it as a positive in that if the alternative is this massive underground, illegal sports betting industry, and to the extent that daily fantasy sports, albeit not viewed as gambling under the law, is a form of entertainment and engagement that fans want to engage in and enjoy. "It's something I've spent a lot of time studying and trying to understand, looking at how other jurisdictions deal with it as well outside of the United States where our sport is very popular."
