Schleswig-Holstein Between the EC and German Gambling Regime
Schleswig Holstein lawmakers once again failed to hold a second reading on their new bill to re-join the restrictive German Interstate Treaty. The draft proposal which would abandon online gambling laws approved by the European Commission has been put off until next year. The European Commission has already voiced serious concern over the German gaming laws compliance with EU rules and European Court of Justice findings. Because of the constraints and time limits associated with the EC's opinion, the federal court in Germany is scheduled to pronounce on the legality of the federal German gambling legislation later in the month. Meanwhile, SH has continued to issue sports betting licenses under its existing law whilst the new legislation has been developed, creating more confusion and possibly future legal actions from displeased licensees. Anyway, this week marks the end of the Schleswig Holstein legislative season, and the earliest vote on the new Gambling Act can take place on January 7, 2013.
